SUBJECT: RWANDA: ARUSHA PEACE TALKS WINDING DOWN
U.S. OBSERVER JOYCE LEADER PROVIDED THE FOLLOWING REPORT
FROM ARUSHA.
WINDING DOWN
1. SINCE THE JUNE 9 SIGNING OF THE PROTOCOL ON REFUGEE
RETURN AND THE REINSTALLATION OF DISPLACED PERSONS, THE
GOR AND RPF DELEGATIONS HAVE BEEN WORKING FACE-TO-FACE ON
OUTSTANDING MILITARY ISSUES AND PUSHING AHEAD ON
CONSTITUTIONAL QUESTIONS AND THE DURATION OF THE
TRANSITION. TANZANIANS WILL PUSH BOTH SIDES TO SET A DATE
FOR THE SIGNING OF THE PEACE ACCORD BEFORE THE OAU SUMMIT
IN CAIRO.

2. A SMALL JOINT GOR-RPF TEAM HAS BEEN WORKING ON
APPLICATION OF THE FORCE PROPORTION RATIO TO THE ARMY,
INCLUDING THE QUESTION OF THE EXTENT TO WHICH THE COMMAND
LEVEL WILL BE INTEGRATED AT 50-50. THE GOR DELEGATION HAS
YET TO RECEIVE FORMAL INSTRUCTIONS TO ACCEPT THE 40-60
RATIO AGREED IN KIGALI EARLIER IN THE WEEK, BUT THE
FOREIGN MINISTER TOLD U.S. OBSERVER THAT HE EXPECTS THE
COUNCIL OF MINISTERS TO ENDORSE THIS AT ITS 6/11 MEETING
AND IS PROCEEDING ACCORDINGLY. (DEPARTMENT COMMENT:
AMBASSADOR FLATEN INFORMED US LATE FRIDAY AFTERNOON THAT
THE CABINET DID ENDORSE THE RATIO, BUT ATTACHED ADDITIONAL
CONDITIONS. HE BELIEVED INSTRUCTIONS WERE BEING SENT TO
THE GOR DELEGATION IN ARUSHA FRIDAY NIGHT. END COMMENT)

3. THE ISSUE OF HOW TO INTEGRATE THE GENDARMERIE WHILE
MAINTAINING SECURITY IS STILL PENDING. BOTH SIDES HAVE
ACCEPTED THE CONCEPT OF PHASING INTEGRATION, POSSIBLY OVER
A TWO-YEAR PERIOD, SO RPF MEMBERS CAN RECEIVE THE BASIC
6-MONTH GENDARME TRAINING. LOOSE ENDS STILL EXIST ON THE

DEMILITARIZATION OF KIGALI AND THE TIMING OF THE FORMATION
OF THE BROAD-BASED GOVERNMENT. THE RPF HAS, HOWEVER, MADE
SEVERAL IMPORTANT CONCESSIONS BY ACCEPTING DISENGAGEMENT
ARRANGEMENTS INSISTED UPON BY THE FACILITATOR: HEAVY
WEAPONS STORAGE SITES WILL BE GUARDED ONLY BY THE NEUTRAL
INTERNATIONAL FORCE (NIP); THE NIF WILL DETERMINE WHERE
ASSEMBLY POINTS AND CANTONMENT SITES WILL BE LOCATED (NMOG

GENERAL OPALEYE TOLD THE TANZANIAN DELEGATION 6/7 THAT THE
CURRENT RPF TERRITORY IS LIKELY TO SUFFICE FOR THE RPF
SIDE, EVEN TAKING INTO CONSIDERATION RETURN OF THE
DISPLACED); ROCKET-PROPELLED GRENADE LAUNCHERS (RPG'S)
WILL BE CONSIDERED "HEAVY WEAPONS."
CONSTITUTIONAL ISSUES
4. THE RPF HAS APPARENTLY DROPPED ITS DEMAND FOR
SUSPENSION OF THE CONSTITUTION, POSSIBLY UNDER DIPLOMATIC
PRESSURE FROM UGANDA'S OBSERVER INSPIRED BY THE
TANZANIANS. GOVERNMENT DELEGATES SAY THE RPF PROVIDED
LANGUAGE FOR A CLAUSE AMENDING THE CONSTITUTION WHICH
WOULD CITE THE ARTICLES OVER WHICH THE PROVISIONS OF THE
PEACE ACCORD WILL TAKE PRECEDENCE. THEY SAY THE AMENDMENT
WILL BE MADE HERE WITHOUT RELYING ON THE NATIONAL
ASSEMBLY, BUT THIS REMAINS TO BE CLARIFIED. HOWEVER, ON
6/11 AN RPF DELEGATION LEADER, WHO HAD ARGUED FORCEFULLY
TO THE U.S. OBSERVER ON 6/9 FOR SUSPENSION OF THE
CONSTITUTION, SAID THAT THE ISSUE WAS STILL OPEN WITH
THREE RPF PROPOSALS ON THE TABLE.
DURATION OF THE TRANSITION
5. THIS REMAINS CONTENTIOUS. THE GOVERNMENT PROPOSES 6
MONTHS FOLLOWING THE INTEGRATION OF THE ARMY, OR ABOUT 15
MONTHS. THE RPF HAS REITERATED ITS DEMAND FOR A 4-YEAR

TRANSITION TO ALLOW FOR: 1) THE ARMY TO FUNCTION AS ONE
UNIT; 2) THE RPF TO IMPLANT ITSELF AS A POLITICAL ENTITY
INSIDE RWANDA; AND 3) THE ESTABLISHMENT OF PROCEDURES TO
ALLOW REFUGEES TO PARTICIPATE IN THE POLITICAL PROCESS
(BACKING AWAY FOR EARLIER DEMAND FOR ALL REFUGEES TO HAVE
RETURNED BEFORE THE ELECTIONS). IT SEEMS LIKELY TO
OBSERVERS THAT COMPROMISE MAY BE FOUND AT TWO TO TWO AND A
HALF YEARS.
NMOG EXPANSION
6. OAU OBSERVER ADVISES THAT THE OAU IS MOVING FORWARD ON
PUTTING A 240-MAN FORCE IN THE BUFFER ZONE AS SOON AS
POSSIBLE, WITH THE INTENTION OF TRYING TO EXPAND FURTHER,
TO A FULL BATTALION, ONCE THE PEACE ACCORD IS SIGNED. HE
IS CHECKING WITH ADDIS ABOUT WHY THE ROSS REPORT, STATING
FORCE REQUIREMENTS, HAS NOT BEEN MADE AVAILABLE TO DONORS.
UN/OAU COOPERATION
7. FOREIGN MINISTER NGULINZIRA HAD UN OBSERVER INFORM THE
UN/SYG THAT THE GOR DOES NOT/NOT WANT A UN-LED FORCE IN
THE BUFFER ZONE BEFORE THE PEACE ACCORD IS SIGNED. THIS
IS AN EFFORT TO COUNTER THE NEGATIVE FALL-OUT FROM THE
PRESIDENT'S LETTER TO THE UN/SYG DELIVERED BY DEFENSE
MINISTER GASANA THAT FOUND ITS WAY INTO BOTH THE BARIL
REPORT (PARA 6) AND THE DRAFT SECURITY COUNCIL RESOLUTION

ON THE BORDER FORCE (PARA 8). THIS AND THE PROPOSED
BORDER FORCE ARE APPARENTLY CAUSING THE RPF TO STALL ON
SEEKING AN EARLY RECONNAISSANCE MISSION FOR THE UN-LED
PEACE-KEEPING FORCE FOR AFTER THE ACCORD IS SIGNED. A
JOINT LETTER ENDORSING THE UN-LED FORCE AND REQUESTING A
RECONNAISSANCE MISSION IS IN DRAFT.
